1.     A HEARING on VERIZON NEW ENGLAND, INC. for location of one (1) 4” Conduit and one (1) Manhole at 838 SOUTH RODNEY FRENCH BOULEVARD.

1a.    AN ORDER,

MAYORS PAPERS

M1.      COMMUNICATION, Mayor Mitchell, to City Council, submitting AN ORDER authorizing the Mayor to enter into a Master Lease Agreement in the amount not to exceed $3,684,000.00 for the financing of the costs of Phase 2 energy conservation measures and facility measures to various municipal buildings and facilities pursuant to the master energy management services agreement between the City and Siemens Industry, Inc.

M1a.    AN ORDER,

M2.      COMMUNICATION, Mayor Mitchell, to City Council, submitting AN ORDER authorizing the Mayor to execute, on behalf of the City of New Bedford, an Activity and Use Limitation (AUL) for City-owned property located off Manomet Street.

M3.      COMMUNICATION, Mayor Mitchell, to City Council, submitting AN ORDER for the TRANSFER of $54,159.00 from AIRPORT STABILIZATION, to AIRPORT, OTHER FINANCING USES.

M4.      COMMUNICATION, Mayor Mitchell, to City Council, submitting AN ORDER for the TRANSFER of $7,000.00 from FIRE, SALARIES & WAGES, to FIRE, CHARGES & SERVICES.

M5.      COMMUNICATION, Mayor Mitchell, to City Council, submitting a ONE-YEAR Waiver of Residency for SCOT SERVIS, Airport Manager, who resides in Lakeville, MA.

M6.      COMMUNICATION, Mayor Mitchell, to City Council, submitting the REAPPOINTMENT of Kathryn Duff, New Bedford, MA to the PLANNING BOARD; this term will expire October 2020.

NEW BUSINESS

2.     REPORT, Committee on Finance, recommending to the City Council to take a NO FURTHER ACTION on the WRITTEN MOTION, Councillor Gomes, requesting, that the Committee on Finance meet with a Representative of the Mayor’s Office and the Commissioner of the Department of Public Infrastructure, Zeb Arruda, for the complete financial costs of the second hurricane barrier walkway located on the west side of Cove Road; and further, that the Committee Members be provided with a breakdown of the costs associated with said walkway.

 

2a.     WRITTEN MOTION, Councillor Gomes, requesting, that the Committee on Finance meet with a Representative of the Mayor’s Office and the Commissioner of the Department of Public Infrastructure, Zeb Arruda, for the complete financial costs of the second hurricane barrier walkway located on the west side of Cove Road; and further, that the Committee Members be provided with a breakdown of the costs associated with said walkway. (Referred to the Committee on Finance – February 23, 2017.)

3.     WRITTEN MOTION Councillors Rebeiro, Abreu, Morad and Carney, requesting that the Committee on Appointments and Briefings hold a meeting as soon as possible to discuss how the Harbor Master Plan, State regulations on designated port areas and Chapter 91 of the General Laws apply to 4 Wright Street in New Bedford as well as to other properties in the port area; and further that a Representative from Coastal Zone Management, Department of Environmental Protection/Waterways Division, the Harbor Development Commission, the Planning Department and Inspectional Services, as well as the owner of 4 Wright Street be invited to the meeting to provide information to the Committee with regard to this matter.

4.     WRITTEN MOTION, Councillor Winterson, Council President Lopes, Councillors Abreu, Gomes, Martins and Carney, requesting, that the City Council send a letter to our local State and Federal Delegations in opposition of Senate Bill #279 and House Bill #304, due to the fact that the approval of said bills will strip our local schools and educators of their rights and voices.

5.     WRITTEN MOTION, Councillor Coelho, requesting, that the Police Department enforce Ordinance, Chapter 17, Section 17-25 Relative to Recreational Vehicles, due to the havoc that certain individuals are causing in neighborhoods by the illegal use of recreational vehicles i.e. mini motorcycles, ATVs, dirt bikes, etc; and further, for any individual violating this Section of the City Code that the penalty be strictly enforced.  (To be Referred to Mayor Mitchell, Police Chief Cordeiro and the Committee on Public Safety and Neighborhoods.)

6.     WRITTEN MOTION, Councillor Abreu, requesting, that the City Council engage in dialogue with our Health Department and the Department of Inspectional Services about implementing mandatory CPR and Heimlich training and certifications for all New Bedford restaurants, bars, food-related cafes and establishments which seat less than 25 patrons, currently, Massachusetts General Law (105:CMR - Mass Dept. of Health 590.003(A)(2) Mgmt. and Personnel) has only established a mandatory statewide law for all restaurants which seat 25 or more patrons that they must have on its premises while food is being served a person trained and certified in CPR; and further, a collaborative approach on the local level on this issue could help potentially save lives. (To be Referred to the Committee on Ordinances, the Health Department and the Department of Inspectional Services.) 

 

7.     WRITTEN MOTION, Councillor Coelho, requesting, that Mark McGraw, Director of Emergency Medical Services be invited to the Committee on Public Safety and Neighborhoods to discuss the number of calls for 2017 that the City has received for Opioid overdoses, any zones or areas that get the most calls for overdoses and a percentage of calls that are for repeat overdoses. (To be Referred to the Committee on Public Safety and Neighborhoods.)

8.     WRITTEN MOTION, Councillor Rebeiro, requesting that the parcels of land at 473 County Street (New Bedford Assessor’s parcel ID 52/170) and the parcel on the South Side of Elm Street (New Bedford Assessor’s parcel ID 52/169) be rezoned from Residence A to Mixed-Use Business.  (To be Referred to Committee on Ordinances and Planning Board).

9.     WRITTEN MOTION, Council President Lopes, Councillors Abreu, Winterson, Dunn and Oliveira, requesting that the City Council look into adopting a Wage Theft Prevention Ordinance modeled after the Town of Quincy.  (To be Referred to the Committee on Ordinances.) 

 

9a.     COMMUNICATION, Council President Lopes, submitting a Wage Theft Prevention Ordinance from the City of Quincy, MA.  (To be Referred to the Committee on Ordinances.)

10.     WRITTEN MOTION, Councillor Gomes, requesting that Mayor Mitchell and Fire Chief Gomes take immediate action to address and explain why the Downtown New Bedford Firehouse – Station One has no reserve ladder truck in place; and once more explain why preventative maintenance is not being taken with fire apparatus across the City, black outs are leaving the Downtown area and neighborhoods without a functioning ladder truck especially the high-rise buildings in the Downtown area; and further, that immediate action be taken to borrow a ladder truck from another company in the surrounding area while this matter is being addressed; furthermore, that the Committee of Public Safety and Neighborhoods once more meet with the Administration, the Fire Chief and the Department of Facilities and Fleet Management to discuss the problems, to make sure that the Fire Department has the best working fire apparatus to protect and serve the City in New Bedford.

11.     WRITTEN MOTION, Councillor Gomes, requesting, that the City Council go on record in support of Governor Baker’s proposing to make drug dealers whose distribution leads to the death of a user, subject to prosecution for manslaughter; and further that our State Delegation support Governor Baker’s proposal in targeting narcotics dealers.
