M1.      Mayor Mitchell, to City Council, submitting AN ORDER, authorizing the Mayor to execute a contract with Veolia Water North America – Northeast, LLC (“Veolia”), for operation, maintenance and management services for the Wastewater Treatment Facility located at 1000 South Rodney French Boulevard and for the City’s 29 sewage pumping stations. The term of said contract is ten years, and it gives the City the option to exercise two five-year extensions.

 

M1a.    AN ORDER,

M2.      Mayor Mitchell, to City Council, submitting AN ORDER, authorizing the Mayor to execute on behalf of the City of New Bedford, a One Year Short Term Tenancy Agreement between the City of New Bedford, acting through its Airport Commission and the Commonwealth of Massachusetts, acting by and through the Commissioner of its Division of Capital Asset Management and Maintenance on behalf of Bridgewater State University.

M3.     COMMUNICATION, Mayor Mitchell, to City Council, submitting AN ORDER for the TRANSFER of $2,000.00, from the FIRE CODE ENFORCEMENT RESERVE FOR APPROPRIATION to FIRE SUPPLIES AND MATERIALS.

 

M3a.     AN ORDER,

M4.      COMMUNICATION, Mayor Mitchell, to City Council, submitting the RE-APPOINTMENT of KATHRYN DUFF, New Bedford, MA, to the Planning Board; this term will expire October 2023.
NEW BUSINESS

1.     REPORT, Committee on City Property, recommending to the City Council APPROVAL of the ORDER, authorizing the City to execute a Lease between the City of New Bedford and David Street, LLC for the purpose of housing furniture donations for the Department of Community Services’ Fresh Start Program.

 

1a.     AN ORDER, authorizing the Mayor to execute a Lease between the City of New Bedford and David Street, LLC.  (Referred to the Committee on City Property August 20, 2020.)

2.     REPORT, Committee on Ordinances, recommending to the City Council APPROVAL, as Amended, of the ORDINANCE, Relative to Residency of City Personnel.

 

2a.     AN ORDINANCE, (Referred to the Committee on Ordinances - July 16, 2020.)

3.     WRITTEN MOTION, Councillors Giesta, Abreu, Carney, Baptiste, Markey and Morad, requesting, that our Federal Legislative Delegation, Senators Warren and Markey and Congressman Bill Keating expand the Opportunity Zone Program in New Bedford, the US Tax Cut and Jobs Act of 2017 created the Opportunity Zone Program to provide incentives for investment in low income communities and we are asking that this program be expanded to areas of Ward Two, and other relevant neighborhoods throughout the City; and further, New Bedford is one of the largest Gateway Cities in the Commonwealth of Massachusetts, and the expansion of the Opportunity Zone Program would promote economic redevelopment, it is very important that we have a strong and dynamic Downtown, but there are many other areas of the City that should be redeveloped, and we believe the Opportunity Zone Program would help accomplish this mission. (To be Referred to the Planning Department and Derek Santos at the Economic Development Council.)
4.     COMMUNICATION/DEMOLITION, New Bedford Historical Commission, to City Council, re: BUILDING DEMOLITION REVIEW OF 1123 OLD PLAINVILLE ROAD, (MAP 125, LOT 36) a Circa 1858, wood framed one-story residence - advising that “the building’s location was once part of Plainville Village, an area which was characterized by its rural setting consisting of large expanses of farmland, farmhouses, a schoolhouse, post office and by the later part of the 19th century, a horse track; the building has  been significantly altered and does not retain integrity in its materials and no longer embodies distinctive characteristics of its type; the building and its association with the historic setting is not conveyed by its current condition, “in light of these findings, the New Bedford Historical Commission has determined that the building at 1123 Old Plainville Road is neither a Historically Significant nor a Preferably Preserved Building.”
5.     COMMUNICATION, City Clerk/Clerk of the City Council, to City Council, on behalf of Anthony Snow, 12 Humes Street, Pawtucket, RI 02860  d/b/a CAB TRANSPORTATION LLC, 12 Welby Road, New Bedford, MA 02745, hereby submitting a copy of the Application requesting a RENEWAL of a PRIVATE LIVERY LICENSE, to carry passengers for hire over the streets of New Bedford. (Term of License July 1, 2020 – June 30, 2021.)
6.     COMMUNICATION, Manuel DeBrito, Jr., Chairperson, Board of Election Commissioners, to City Council, submitting the Election Warrant for the Tuesday, November 03, 2020, General Election, the Warrant needs to be signed by the majority of the City Council and must be posted on the 7th day prior to the Election as mandated by M.G.L. c43, §44A, a copy of this Warrant will be posted at each polling location.
7.     COMMUNICATION, Councillor Gomes, submitting a communication from Hank Turgeon, President, New Bedford Police Union, relative to the defunding of the Police Department and the Police Union's proposed budget cuts.
